What a deposition is
U.S. Courts explains that discovery may include a deposition in which a witness answers questions under oath before trial while a court reporter creates a transcript. Rules differ by court and jurisdiction.
What preparation is for
Preparation helps a witness understand the setting, review relevant source records, listen to each question, and answer truthfully without guessing. It is not a process for memorizing a preferred story.
Documents and objections
A notice may identify topics or documents. Lawyers may make objections according to the applicable rules, but the witness may still need to answer unless instructed otherwise on a permitted ground.
After the session
The transcript may be reviewed or corrected under applicable procedures and may be used in motions or at trial. Ask counsel about the rules that apply to the particular deposition.
