Identify the percentage and base
Ask which percentage applies at each stage and what amount the percentage is calculated from. Terms vary by agreement and may be regulated by jurisdiction or case type.
Separate fees from expenses
Filing fees, records, experts, depositions, travel, and other case costs may be treated separately from the lawyer’s fee. Ask when they are deducted and who is responsible if there is no recovery.
Define the scope
Confirm whether the agreement covers an appeal, lien negotiation, related claims, or only a specified matter and stage. Work outside the scope may require another agreement.
Request a sample closing statement
A hypothetical calculation can show the order in which fees, expenses, liens, and other deductions are applied. The actual closing statement should account for the final figures.
